The Constitution as the President's Guarantor

 

 

 

 

As is well known, the constitution is the fundamental law of the state. A democratic constitution provides for the principle of separation of powers: legislative, executive, and judicial. A constitution is adopted by referendum once and for all; otherwise, it loses its significance as the highest legal force. Thus, the US Constitution was adopted in 1787 and remained essentially unchanged, taking into account 10 important amendments introduced in the first four years. The remaining 17 amendments, including minor ones such as Prohibition and the amendment repealing it, essentially did not change the political structure of the state.

 

The last constitution in Russia was adopted in 1993 and has been amended repeatedly at the instigation of President Putin, the guarantor of the constitution, as he proudly called himself. Following each of Putin's promises to treat the constitution as sacred, amendments were introduced to the organization of the executive branch. While the amendments to the American Constitution promoted democracy, in Russia, all the amendments are nothing more than sheer chicanery, negating the very meaning of the constitution as such.

 

As a result of these changes, a metamorphosis has occurred: no longer is the president the guarantor of the constitution, but the constitution has become the guarantor of the president, that is, Putin. While in mathematics, rearranging the terms doesn't change the sum, in our case, rearranging who is whose guarantor fundamentally alters the final meaning. In reality, we are witnessing the emergence of an absolute monarchy, where parliament is a lapdog on a leash. And it's best not to even discuss the judiciary and appointed governors.

 

In fact, such a constitutional change was to be expected, given Putin's definition of democracy in Russia as a sovereign democracy, which should be understood as nothing less than democracy for the sovereign (1). This definition of democracy is fully illustrated by the general political situation in Russia, which would be rash to call a democratic country. There is no democratic country in the world where a president can remain unchallenged for more than 20 years! This is nonsense, but not for Russia, with its servile people, who therefore do not understand and reject democracy (2, 3).
